The unique legal status of Oklevueha Native American Church is substantiated by the following United States Government Agencies opinions and statutes; FIRST by the “United States Attorney General Office Memorandum– “Our research has identified no religious organizations, other than the NAC, which would qualify for the exemption under these or similar procedural and substantive requirements“ and SECOND by the DEA Code of Regulations -Exemptions from federal and state Drug Laws.

ONAC Membership Card Holders are granted United States Constitutional Rights and Protections as the First Amendment of the Bill of Rights clearly states and as the Religious Land Use and Institutionalized Persons Act of 2000 outlines these rights and protections in detail, even if one is NOT of American Native Heritage, See United States v. Boyll, May 10, 1990 – Federal Tenth Circuit Court of Appeals Unanimous Ruling and State of Utah Supreme Court Unanimous Ruling.

Government Agencies have no legal authority to legislate what Earth Based Substance; plant, cacti, vine and/or herb that a Oklevueha Native American Church member chooses to utilize as their Sacrament, See United States Supreme Court Unanimous Ruling.

ONAC University of Indigenous Medicine is a Faith Based Organization under the governance of Oklevueha Native American Church and only works within the Sovereign Membership at large. 

The Following definition of Naturopathy was passed by the United States Congress on February 7th 1931, without a dissenting vote.  Section 2. It is further enacted that Naturopathy as used in the aforesaid act approved February 27, 1929, hereafter shall comprehend, embrace and be comprised of the following acts, practices, and usages.  “Diagnosis and practice of physiological and material science of healing as follows, “The physiological and mechanical sciences such as mechanotheraphy, articular manipulation, corrective orthopedic gymnastics, neurotherapy, psychotherapy hydrotherapy, mineral baths, electrotherapy, thermotherapy, phototherapy, chromotherapy, vibrotherapy, and dietetics which shall include the use of foods of such biochemical tissue building products and cell salts found in the normal body; and the use of vegetable oils dehydrated and pulverized flowers, seeds, bark, herbs, roots and vegetable uncompound in their natural state. 

“Passed the House of Representatives February 7, 1931, attest William Tyler Parks’s clerk, “ Thus all minerals of any and all natural elemental, and tissue and cell chemicals and salts required for the health of the body organism, and for all it’s function health and wellbeing- are authorized in usage as the legitimate right of each and every person in Naturopathic Practice by a definite and specific Act of the United States Congress.  And as any Act of Congress is a Supreme Ruling above any contrary of the individual states.--this Act at once exempts any and all Naturopathic practitioners from the medical and legislative restrictions in the various states; giving Naturopaths freedom to practice Naturopathy in any and all its departments according to their professional schooling and training.  Therefore and hereafter any graduate of and departments of Naturopathy who according to his or her skill and training diagnoses sickness, disease and human ailments and who treats the sick, diseased and suffering and all and all and varied human ailments and afflictions according to the methods and processes here and defined and who restores health and wellbeing by the processes and methods outlined in the Act of the United States Congress- are not practicing medicine or surgery without a license as formerly asserted by the allopathic trust  and as specified by their various legislative enactments.  They are rightfully and legitimately practicing Naturopathy.  And thus, this Act nullifies all such legitimately enactments; for the Federal Laws of the United States Government at Washington–are the Supreme Laws of the Land.  For so it is written in the Constitution and laws of the United States which shall be made in pursuance thereof this includes all Acts of Congress…shall be the supreme law of the land; and the judges in every state shall be bound thereby-anything in the Constitution of Laws of Any State shall be bound thereby- anything in the Constitution of laws of any state to the contrary notwithstanding’ Article Six, Clause Two.

1.  In certain instances as enumerated in Title 58, Chapter 68, Section 305, and Title 58, Chapter 1, Part 3, section 307 of the Utah State Code, Professionals already engaging in the practice of medicine may be exempted from meeting all the state's requirements. Some of these summarized exceptions include:

• The professional is licensed in another state and has been practicing medicine for at least ten years.
• The professional's services are rendered for "public service" or "non-commercial" purposes.
• The professional does not charge for their services beyond what is needed to cover "malpractice insurance."
• A professional "administering a domestic or family remedy."
• A person engaged in good faith "in the practice of the religious tenets of any church or religious belief without prescription drugs."
• A professional who is invited by a school, society, etc., to conduct a demonstration of the practice of medicine.
